Plain-language summary: you get a free PulseMax Pro, you post at least 5 honest videos within 4 weeks of it arriving, tag Flosii in each one and send us the links, you earn 20-30% commission on every flosser sold with your code or link, and Flosii can use your Flosii content on its website, social channels and ads. If the videos aren't posted, you send the flosser back at your own shipping cost. Flosii pays you directly by bank transfer each month, and you'll get our program emails. That's it.

1. Who this agreement is between and what it covers

1.1 This agreement is between Flosii Group Limited, trading as Flosii (www.flosii.co, hello@flosii.co, New Zealand) (Flosii), and you, the creator named in the signature section below.

1.2 It covers the Flosii Creator Program: the free PulseMax Pro you receive, the content you post about it, the commission you earn, how you are paid (section 5.5), how Flosii may use that content, and how we keep in touch with you (section 7.6A).

1.3 It starts on the date you sign and continues until either of us ends it under section 6 or 7. Sections 4, 5.6, 7 and 8 continue after it ends.

1.4 The Flosii Creator Playbook gives friendly tips on filming and posting. The Playbook is guidance only; if anything in it differs from this agreement, this agreement applies.

2. Your free PulseMax Pro and what you post

2.1 The gift. After you have signed this agreement, Flosii sends you one PulseMax Pro water flosser free of charge, with tracking, to the delivery address you give when you sign. Once the deliverables in 2.2 are posted, it is yours to keep.

2.2 The deliverables. Within 28 days of the flosser being delivered to you, you will post:

• at least 5 videos (Instagram Reels, TikToks or YouTube Shorts) featuring the PulseMax Pro, each a separate video; and
• Stories that tag Flosii and include your personal link or code.

2.3 The 28 days are counted from the delivery date shown in the courier tracking. If you need a few more days (illness, travel), email hello@flosii.co before the deadline and we'll agree a new date in writing.

2.4 Videos stay on your public profile for at least 60 days. You choose your own ideas, words and style; Flosii does not script your content or need to approve it before you post.

2.5 Tagging and links. Tag Flosii's account in every post and email the link to each post to hello@flosii.co within 48 hours of posting (or reply to our check-in email with the links), so we can find, reshare and use your content under section 4. If we ask, you'll send the original video files within 7 days.

3. Honest content and disclosure

3.1 Your own experience. Everything you post is your own genuine experience and opinion of the PulseMax Pro, in your own words. Only describe things that actually happened to you.

3.2 Disclosure. Every post, video and Story about Flosii clearly shows it is a partnership, using #ad or the platform's Paid Partnership label, visible without tapping "more". This is required by advertising rules in New Zealand and Australia.

3.3 Claims. Please don't:

• present your experience as medical or dental advice, or as a promised result for anyone else;
• use numbers, statistics or professional endorsements (for example "dentist recommended") unless Flosii has given them to you in writing or a professional actually said it to you;
• name, compare with or criticise other brands, or say or suggest that you bought the flosser yourself.

3.4 Issues first to us. If anything isn't right with your flosser, tell us privately at hello@flosii.co first and we'll put it right.

3.5 Content standards. Only film people who have agreed to be filmed (a parent or guardian's OK for anyone under 18). No unsafe use of the product, nothing unlawful, hateful or adult, and no other oral-care brands in shot.

3.6 Your responsibility. You are responsible for your own content, the statements you make in it, your disclosures, and any music, images or people in it. Flosii is not responsible for content you create or post.

4. Using your content

4.1 You own your content. You keep ownership of everything you create.

4.2 Using your content on our website and ads. By signing this agreement you give Flosii the right to use the content you create for us on Flosii's website, emails, social channels and paid ads on any platform. In legal terms, you give Flosii a non-exclusive, worldwide, royalty-free, irrevocable licence to repost, share, trim, edit, cut and combine with other footage, caption, resize and publish that content (including your name, handle, voice and image as they appear in it) in those places, including after the partnership ends.

4.3 Partnership ads. When Flosii asks, you'll accept Instagram/Facebook partnership-ad requests and share a TikTok Spark Ads code (with the longest authorisation the platform offers) for your Flosii videos, so the ads can run from your handle.

4.4 Fair use of your words. Flosii won't change the meaning of what you said, cut it in a way that changes your overall opinion, or add claims you didn't make.

4.5 No extra fees. The free PulseMax Pro and your commission are the full payment for this content and its use. Any paid usage fee or extra deliverable must be agreed in writing by Flosii first.

4.6 Music. Trending sounds you use inside an app may not be licensed for ads; Flosii may swap or remove the music when using your video as an ad.

5. Commission, your code and payouts

5.1 What earns commission. You earn commission on every Flosii PulseMax Pro water flosser bought through your personal creator code or creator link, both issued by Flosii. Other products (nozzles, accessories, whitening, UltraScale) don't earn commission.

5.2 How it's calculated. Commission is a percentage of the price the customer paid for the flosser, as shown in your monthly statement from Flosii. Orders that are cancelled, refunded or returned don't earn commission.

5.3 Tiers. Flosii reviews tiers on the first working day of each month using the previous month's flosser sales (after returns and cancellations). A new tier applies from that review.

5.4 Your code. Your personal code gives your audience 10% off our everyday price of the PulseMax Pro, one use per customer. Only one discount code works per order, so during Flosii sales your followers may choose the sale price instead; orders placed through your personal link still count for your commission. Flosii may update the offer for future orders with notice to you by email.

5.5 How you are paid. Flosii pays you itself by bank transfer to the New Zealand or Australian bank account you give when you sign, once a month (by the 15th). Each payment covers commission on flosser orders placed in the previous month that are at least 30 days old (later orders are paid the following month, so returns can clear), plus any other payment Flosii has agreed with you in writing (for example buying one of your videos). You get a statement by email with each payment. Payments are made in NZD to New Zealand accounts and in AUD to Australian accounts, through our bank or payment provider (for example Wise). Please keep your bank details up to date by emailing hello@flosii.co; Flosii is not responsible for a payment sent to the account details you gave us. If you were invited through Shopify Collabs, Collabs is used only for the invite: your commission and other payments are paid as set out here, not through Collabs.

5.6 Fair play. Your code and link are personal to you. Commission is not payable, and may be reversed, on orders:

• you place for yourself or your household, or that are paid for or arranged by you;
• coming from coupon, deal or cashback sites, or from paid search ads that bid on "Flosii" or Flosii product names;
• that are fraudulent or later charged back.

If your code is shared somewhere it shouldn't be, Flosii may replace it with a new one.

5.7 Second units. Creators who are selling can buy extra units at a special creator price. From time to time Flosii may offer top creators extra incentives or giveaway units; each is confirmed in writing by Flosii.

6. If the videos aren't posted, and ending the partnership

6.1 Returning the flosser. If the 5 videos in section 2.2 aren't posted within 28 days of delivery (or the new date agreed under 2.3), you'll return the PulseMax Pro to Flosii at your own shipping cost, within 14 days of our email asking for it. We'll send you the return address.

6.2 Ending the partnership. Either of us can end the partnership at any time by email. Flosii may end it if these terms aren't met, for example if videos aren't posted, a code is misused, or content doesn't follow section 3.

6.3 After it ends. Commission on flosser orders made before the end date is still paid under section 5 (except orders under 5.6). Your code and link stop working. Content you have already created stays available to Flosii under section 4, and you're welcome to leave your posts up.

7. General terms

7.1 Independent creator. You're an independent contractor, not an employee, agent or partner of Flosii. You can't make promises, agreements or statements on Flosii's behalf. You're free to work with other brands, except other water-flosser or oral-irrigator brands during the 28-day posting period.

7.2 Taxes. You're responsible for any income tax, GST or other tax on your commission and on the gifted product, and for registering for GST if you need to.

7.3 Your promises. You confirm that you're at least 18, that the details you give us are accurate, and that you have the rights to everything in your content (music, images, people).

7.4 Claims about your content. If someone makes a claim against Flosii because of something in your content that doesn't follow this agreement, you'll cover Flosii's reasonable costs of that claim.

7.5 Limit of liability. Flosii isn't liable for indirect losses or lost income. Flosii's total liability to you under this agreement is limited to the commission paid to you in the 12 months before the claim. Nothing in this agreement limits rights that can't be limited by law, including under the Consumer Guarantees Act 1993 (NZ) or the Australian Consumer Law where they apply.

7.6 Privacy. Flosii uses your details (name, contact details including your mobile number, address, handles, payout details and signed agreement) only to run the program: shipping, payouts, records, contacting you and the creator community. They're kept securely under the Privacy Act 2020 (NZ) and shared only with the services we use to run the program (such as Shopify, our email and payment providers, and WhatsApp). You can ask to see or correct them at hello@flosii.co.

7.6A Staying in touch. By signing, you agree that Flosii may:

• add you to our creator list and send you program emails, such as welcome and onboarding emails, check-ins during your 28 days, briefs and tips, monthly sales and commission statements, payout notices and program updates;
• contact you by email, text message, WhatsApp or phone about the program and your deliverables; and
• invite you to the Flosii Creators community (for example a WhatsApp community), where Flosii and other members can see the name you use there and, in chat groups, your mobile number.

You can leave the community at any time. Program emails needed to run this agreement continue while you are a Flosii creator. Any promotional emails include an unsubscribe link, and opting out of them does not affect this agreement.

7.7 Whole agreement. This agreement is the whole agreement between us. Nothing agreed outside it (in DMs, calls or messages) applies unless Flosii confirms it in writing by email from hello@flosii.co.

7.8 Changes. Changes to these terms are made as a new numbered version. A new version applies to you only once you sign it. Changes to the code offer follow 5.4.

7.9 Other terms. You can't transfer this agreement to anyone else. If any part of it can't be enforced, the rest still applies. Notices are sent by email to the addresses in the signature section. This agreement is governed by New Zealand law, and the New Zealand courts have jurisdiction.

8. Signing electronically

8.1 We both agree to sign this agreement electronically. You sign by completing the Flosii Creator Sign-up form at flosii.co/pages/creator-agreement: ticking the agreement box and typing your full legal name as your signature. The form records your details and the exact date and time of submission automatically, and emails you a copy of your signed submission straight away. This is your legally binding signature under the Contract and Commercial Law Act 2017 (NZ) and the Electronic Transactions Act 1999 (Cth, Australia).

8.2 Flosii's signature is applied in advance to every copy of this version. The agreement is signed by both of us at the date and time you submit the form. Flosii keeps a secure, time-stamped record of every signed submission and emails you a countersigned copy of this agreement; together these are the signed record for both of us.
